TERMS AND CONDITIONS

1. Low EMF Home Design & Construction course: part 1 Radiofrequency Radiation

1.1. This Low EMF Home Design & Construction Course is provided by OH MY GOODNESS ENTERPRISES PTY LTD trading as The Healthy Home Australia ABN: 26 609 839 643. If you have any questions, please contact hello@thehealthyhome.com.au.

1.2. Subject to the Client’s compliance with this agreement, The Healthy Home will provide the Client with the following benefits:
(a) Live Q & A sessions:
Enrolment includes access to four (4) live monthly group Zoom Q&A sessions specific to the Low EMF Home Design & Construction: Radiofrequency Radiation Course.
a. Zara will be available to respond to questions during the scheduled Q&A sessions only. Questions must be submitted by 12:00pm (AEDT) on the Monday of the week of the scheduled session.
b. All live Q&A sessions will be recorded and made available to enrolled participants.
c. Live participation and contributions are required to meet course requirements.
d. Ongoing live support, additional Q&A sessions, one-to-one review, or consulting support beyond the included sessions are not included and may be offered separately at additional cost.

(b) Access to Low EMF Home Design & Construction Course (Radiofrequency Radiation) content
a. Participants receive ongoing access to the Low EMF Home Design & Construction Course (Radiofrequency Radiation) content for as long as the program remains available and maintained by The Healthy Home in its current format.
b. “Lifetime access” refers to access for the operational life of the program in its current structure, including minor updates, refinements, and improvements.
c. The Low EMF Home Design & Construction Course is a technical and evolving educational program. Zara reserves the right to expand, refine, reorganise, replace, or retire content based on research developments, field experience, industry changes, and professional practice.
d. Significant curriculum expansions, additional modules (including but not limited to AC magnetic fields, AC electric fields, Microsurge Electrical Pollution, DC magnetic fields) may be offered separately and may require additional enrolment and fees.
e. Access to future major expansions or new program formats is not guaranteed and will be determined at Zara’s discretion.

1.3. When participating in the Low EMF Home Design & Construction course, the Client must comply with the reasonable directions of Zara, including directions regarding the Client’s conduct during coaching calls. Zara reserves the right to remove the Client from coaching calls at her sole discretion.

1.4. Access is granted to the enrolled participant only and may not be assigned or transferred.

1.5. Each enrolment permits access for the primary participant and up to one additional nominated team member within the same business.

1.6. Definition of team members: For the purpose of the Low EMF Home Design & Construction course, a team member is defined as an employee or direct collaborator who operates within the same legal business entity as the enrolled participant. This is intended to include those who are actively engaged in the day-to-day operations and projects of the business and who will apply the learnings directly in their shared work environment.

1.7. Privacy: participants agree to respect the privacy and confidentiality of all communications, materials, and discussions during the Low EMF Home Design & Construction course. This includes, but is not limited to, not sharing, distributing, or reproducing any recordings of group calls or materials provided during the course. Participants acknowledge that recordings of group calls will be available for a period of 30 days. By participating in this program, you commit to upholding this confidentiality agreement to foster a safe and trusted learning environment for all.

2. PARTICIPATION AND ATTENDANCE REQUIREMENTS FOR CERTIFICATE OF COMPLETION

2.1. Participants who complete Part 1 (Radiofrequency Radiation) of the Low EMF Home Design & Construction program will receive a Certificate of Completion for this module. To qualify, participants must:

2.2. Attend a minimum of 3 out of 4 live group sessions (and watch recordings if attendance at one of the sessions is missed):

  • Complete each module earning content and quizzes

  • Submit required end of program assessment and practical reflections

  • Demonstrate applied understanding of key RF concepts and how they’ll be integrated into projects.

2.3. Active contribution: Participants must actively contribute to the discussions to demonstrate understanding of the course content and to enrich the collective learning experience. Each of the Low EMF Home Design & Construction course live group calls have a limited number of participants to ensure an interactive and enriched learning environment. Non-attendance or passive participation not only diminishes the individual's learning experience but also impacts the dynamics and value for other participants.

2.4. This certificate recognises completion of Part 1 only.

2.5. Completion of additional modules (AC electric fields, AC magnetic fields, DC fields, Microsurge electrical pollution, etc.) may be required in future to qualify for the full Low EMF Home Design & Construction certificate of completion pathway and logo.

2.6. The Healthy Home reserves the right to define the structure and requirements of any future certificate of completion pathway.

2.7. Participants are responsible for accurately representing their level of training and must not imply full EMF testing certification or specialist qualification beyond the scope of this program.

2.8. Responsibility to attend: It is solely the responsibility of the participant to ensure they meet the attendance and participation requirements. While we may offer reminders, the onus to attend and actively participate remains with the participant. Failure to meet these requirements will result in non-issuance of the Certificate of Completion.

3. INTELLECTUAL PROPERTY

3.1. All course materials, including but not limited to webinars, videos, written content, audio recordings, downloads, frameworks, blueprints, assessments, summaries, and client materials, are the intellectual property of The Healthy Home® or the appropriately attributed party and are protected under applicable copyright and trademark laws.

3.2. All rights are reserved.

3.3. Upon enrolment, participants are granted a limited, non-transferable, non-exclusive licence to access and use the materials for their individual professional use only.

3.4. Materials may not be copied, reproduced, republished, uploaded, distributed, sold, sublicensed, shared, or otherwise used beyond the scope of this licence without prior written consent.

3.5. You may download and/or print materials for your own individual reference.

AI & TECHNOLOGY USE
3.6. Course materials may not be uploaded, copied, summarised, paraphrased, inputted, or otherwise reproduced in artificial intelligence systems or third-party platforms (including generative AI tools) for the purpose of redistribution, content creation, training, or commercial use.
3.7. Personal note-taking or reference use within AI tools is permitted provided the content is not redistributed, reproduced, or used to create derivative commercial material.
3.8. Any unauthorised reproduction or repurposing of course content, including through AI-assisted means, constitutes a breach of this Agreement.

TRADEMARK & LOGO USE
3.9. The Healthy Home® is a registered trademark in the United States and a trademark in other jurisdictions.
3.10. The Low EMF Home Design & Construction™ logo and related branding elements are protected designs and may not be used without written permission.
3.11. Logo usage rights (if granted) are limited to accurate representation of completed training and may not imply endorsement, certification beyond the completed module, or affiliation beyond the scope of this course.
3.12. Misuse or misrepresentation may result in revocation of logo usage rights.

CLIENT MATERIALS, FRAMEWORKS & BLUEPRINTS

4. Client materials provided as part of the course are licensed for use within your own professional practice for the purpose of supporting your clients.
4.1. These materials may be distributed to your direct clients but may not be resold, sublicensed, reproduced, or repurposed into derivative training, courses, or commercial resources without written consent.
4.2. Blueprints, frameworks, summaries, and assessments are proprietary intellectual property and are licensed solely for application within your own professional projects.
4.3. They may not be copied, distributed, shared externally, or used to create competing educational offerings.
4.4. Misuse or misrepresentation may result in revocation of logo usage rights.

5. NON-COMPETE

5.1. The training provided in the Low EMF Home Design & Construction course is for use within your own professional services only. It contains proprietary frameworks, methodologies, and copyrighted materials. You must not use this content to create training materials, educational courses, or derivative programs of any kind without our express written permission.

6. REFUNDS

6.1. If within 30 days of purchase you are not satisfied, we will consider a refund request provided you can demonstrate that you have completed the required modules and implemented the learnings in good faith but found them unsuitable for your needs.

7. PAYMENT PLANS

7.1. Participants opting for a payment plan are required to adhere to the agreed payment schedule. Subsequent payments must be made on or before the due dates outlined in your payment agreement. Failure to make timely payments may result in suspension of access to the program materials and live sessions until the payment is received. Access will be reinstated once outstanding payments are made.

7.2. If a payment is more than 7 days late, The Healthy Home Australia reserves the right to temporarily suspend access to the program. Continued failure to meet payment obligations may result in termination of your participation in the program without refund.

Failure to make timely payments may result in suspension of access to program materials.

8. ASSUMPTION OF RISK

8.1. You are required to familiarise yourself with all relevant legal requirements for conducting a business in your location. You take full responsibility for ensuring that you comply with all applicable local laws and regulations.

8.2. This course is designed to empower designers and builders with the knowledge and practical steps to implement low EMF design and construction practices.

8.3. This course does not qualify participants as Certified EMF Testing Technicians or licensed electrical professionals.

8.4. All building work in Australia must meet certain performance and legal requirements. We do not provide legal advice or compliance certification under the National Construction Code (NCC) or other statutory frameworks…

9. GENERAL DISCLAIMER

9.1. The information that will be provided to you in the Low EMF Home Design & Construction course utilises the Building Biology principles which have been created to take into consideration the impact of home design and building materials on indoor air quality, human health, and our environment. To the best of our knowledge, the information provided is accurate and current.

9.2. New information is always emerging in the world of environmental health and as such our views on the health and environmental impacts of particular building products may evolve over time. We endeavour to ensure the information we share with you is up-to-date and accurate to the best of our knowledge at the time. However, it is always your responsibility to conduct your own research and make appropriately informed decisions. If you find anything in our training or materials that you believe to be outdated, please let us know.

9.3. The Low EMF Home Design & Construction course does not replace professional advice tailored to specific client and project needs, when it comes to building a healthy home, nor is it intended for the treatment or diagnosis of individual diseases or issues. The generic information provided in the course materials is not a replacement for specialist advice tailored to your client’s unique circumstances. While working through the course material, it is important to conduct your own research, consult appropriately qualified professionals and make informed decisions about what is right for you and your client’s particular circumstances.

9.4. The information provided in this course is educational in nature and does not constitute personalised architectural, building, medical, legal, financial or compliance advice. Participants must seek appropriately licensed professionals for project-specific advice.

9.5. All final decisions regarding a home renovation or build must be subject to approval by a licensed architect or building designer, and builder, who is familiar with statutory requirements to ensure compliance with the Building Code of Australia, National Construction Code and (State) Act standards.


10. WARRANTIES & RESULTS

10.1. We make no warranties as to our programs, products, services, courses, or program materials. You agree that course materials are provided “as is” and without warranties of any kind either express or implied.

10.2. We do not guarantee that you will achieve any particular outcome from participation in the Low EMF Home Design & Construction course. The results that you may achieve will vary depending on a wide range of factors beyond our control, including your level of engagement with the report course materials and the particular challenges of your site.


11. INDEMNIFICATION, LIMITATION OF LIABILITY & RELEASE OF CLAIMS

11.1. You agree at all times to indemnify and hold harmless our Company, and any of our partners or experts, from and against any and all claims, causes of action, damages, liabilities, costs and expenses, including legal fees and expenses, arising out of or related to the Low EMF Home Design & Construction course. This indemnity and those below will be reduced proportionately to the extent the liability was caused by our negligence.

11.2. To the fullest extent permitted by law, and subject to Australian Consumer Law, The Healthy Home Australia expressly excludes any liability for any direct, indirect or consequential loss or damage incurred by you or others in connection with this e-course, including without limitation any liability for accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease, condition or issue, physical, mental, emotional, or spiritual injury or harm, loss of income or revenue, loss of business, loss of profits, loss of contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted time and for any other loss or damage of any kind, however and whether caused, even if foreseeable.

11.3. We do not assume liability for any third-party conduct, accidents, delays, harm or other detrimental or negative as a result of your access to the Low EMF Home Design & Construction course and related materials.

11.4. In addition, we will not be liable for any loss, damage, cost or expense, whatsoever, suffered or incurred by any person other than you in connection with the use of the information in this e-course, by that person for any purpose or in any way, including the use of the information for any purpose connected with the sale, purchase, renovation or building of the subject property, to the extent permissible by law.

11.5. You expressly agree that if this limitation of liability is unenforceable for any reason other than negligence, our total cumulative liability for all causes of action of any kind shall not exceed the amount that you have paid to us for the report and e-course.


12. DISPUTE RESOLUTION

12.1. You agree to notify The Healthy Home Australia of any concerns or issues regarding the Low EMF Home Design & Construction course and give us the opportunity to resolve those concerns or issues. Please email us at hello@thehealthyhome.com.au to begin the process.

12.2. If we cannot find a resolution to a dispute or potential claim by means of good-faith negotiation within 21 days, then you explicitly agree to make a reasonable attempt to resolve any such dispute through Alternative Dispute Resolution or Mediation before filing a civil cause of action.

12.3. The mediator is to be appointed by agreement between us or, failing agreement within 21 days of the negotiation period ending, the person initiating the dispute will seek the appointment of a dispute resolution professional. We agree to share all the costs of mediation equally between us.

12.4. You and we undertake that we will not publicly or privately disparage each other, or anyone associated with each other, and will act in good faith to refrain from any conduct or communication which might reasonably be expected to interfere with each other’s business or personal interests.

12.5. Any false or misleading public statements that damage reputation may give rise to legal action.

12.6. This agreement is subject to the governing law of Victoria. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of Victoria, and the Commonwealth of Australia, will have exclusive jurisdiction.
